1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the PSRx Body & Skin website (psrxbodyandskin.com), the PSRx Skin Intelligence Member Portal, our online shop, booking services, and all associated platforms (collectively, the “Services”) operated by PSRx Body & Skin LLC (“PSRx,” “we,” “us,” or “our”).

By accessing or using any of our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Services.

2. Eligibility

You must be at least 18 years of age to use our Services, including the Member Portal, purchase products, or book appointments. By using our Services you represent and warrant that you meet this requirement. PSRx reserves the right to refuse service to anyone for any reason at any time.

3. The PSRx Skin Intelligence Member Portal

The Portal is a subscription-based digital platform that provides AI-assisted skincare protocol recommendations, skin score tracking, educational content, check-in monitoring, product access, and priority booking for active subscribers.

3.1 Not Medical Advice

The Portal is a skincare guidance service, not a medical practice. All content — including AI-generated protocols, product recommendations, and check-in summaries — is for general skin health guidance only. It does not constitute a medical diagnosis, treatment plan, or prescription. It is not a substitute for consultation with a licensed physician, dermatologist, or other qualified healthcare provider.

All AI-generated protocols are reviewed by the PSRx Clinical Review Team before delivery. This review does not transform recommendations into individualized medical advice.

3.2 Subscription & Billing

Portal access requires an active monthly subscription managed through Recharge. Your subscription renews automatically each month on your billing date. You may cancel at any time — cancellation takes effect at the end of your current billing period and you retain access through that date. No partial-month refunds are issued.

Founding member pricing is locked for your first 12 months and transitions to the standard rate thereafter. The founding rate is not reinstated if you cancel and rejoin.

3.3 Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials. Sharing account access is prohibited and may result in immediate termination of your subscription without refund. You agree to notify us immediately of any unauthorized use of your account at info@psrxbodyandskin.com.

3.4 Accurate Information

You agree to complete your skin assessment and check-ins accurately and honestly. Providing false or incomplete information about your health, medications, allergies, or pregnancy status may result in recommendations that are inappropriate or unsafe for your situation. PSRx is not liable for adverse outcomes resulting from inaccurate information.

4. Online Shop & Products

PSRx operates an online shop for skincare and wellness products. By placing an order you agree to pay all applicable fees, taxes, and shipping charges. All sales are final on opened or used products unless the product is defective or arrives damaged.

Product descriptions, pricing, and availability are subject to change without notice. We reserve the right to cancel any order for any reason, including suspected fraud or pricing errors, and will issue a full refund in such cases.

Subscriptions through Recharge are governed by Recharge's terms in addition to these Terms. Cherry patient financing applications are subject to Cherry's terms and credit approval.

5. Bookings & Appointments

Appointment bookings are available through our booking platform. By booking an appointment you agree to our cancellation policy, which requires at least 24 hours' notice to cancel or reschedule without a cancellation fee. Late cancellations or no-shows may be charged a fee at PSRx's discretion.

Portal members with Priority Booking access may book through the Member Portal. Availability is subject to provider schedules and is not guaranteed.

6. Intellectual Property

All content on our Services — including but not limited to AI-generated protocols, educational articles, brand assets, product imagery, portal interface design, and written copy — is the exclusive intellectual property of PSRx Body & Skin LLC. You may not reproduce, distribute, republish, scrape, or resell any content from our Services without prior written permission.

Your personal data and assessment responses remain yours. We use them solely to deliver the Services as described in our Privacy Policy.

7. Prohibited Conduct

You agree not to:

• Use any automated tool, bot, scraper, or crawler to access or extract content from our Services
• Attempt to reverse-engineer, decompile, or access the source code of our software
• Share, sell, or transfer your Portal account or subscription to any third party
• Submit false health information to obtain protocols you are not qualified to receive safely
• Post, transmit, or distribute any content that is unlawful, defamatory, harassing, or infringes any third-party rights
• Interfere with the operation of our Services, servers, or networks
• Use our Services for any purpose that violates applicable federal, state, or local law

8. Disclaimers & Limitation of Liability

Our Services are provided “as is” and “as available” without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

PSRx does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee any specific results from use of the Portal or our products.

To the maximum extent permitted by law, PSRx Body & Skin LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of your use of or inability to use the Services, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to these Terms or the Services shall not exceed the amount you paid us in the 3 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless PSRx Body & Skin LLC, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your use of the Services, your violation of these Terms, or your violation of any third-party rights.

10. Third-Party Links & Services

Our Services may contain links to third-party websites or integrate with third-party platforms (Shopify, Recharge, Cherry, Google, Meta, etc.). We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of any third-party service is governed by that service's own terms.

11. Termination

PSRx reserves the right to suspend or terminate your access to any or all Services at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, our business, or third parties, or for any other reason at our discretion.

Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will survive, including sections on intellectual property, disclaimers, limitation of liability, and governing law.

12. Changes to These Terms

We may revise these Terms at any time. We will notify Portal members of material changes by email and by updating the “Last updated” date above. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Services that cannot be resolved informally shall be submitted to binding arbitration in Cook County, Illinois under the rules of the American Arbitration Association.

You waive any right to participate in a class-action lawsuit or class-wide arbitration against PSRx.
